The Renter may cancel a Booking after they have signed the Rental Agreement subject to a cancellation fee pursuant to the following conditions:
- The Renter must pay 30% of the Total Rental Fee or $200 whichever is the greater. The Renter agrees this is a genuine pre-estimate of the loss which DriveMyCar and the owner suffers as a consequence of the cancellation and which amount the Renter agrees to pay immediately on cancellation;
- if the Rental Period is one month or longer, the Renter must pay to DriveMyCar a minimum of one month’s Rental Fee, which the Renter agrees is a genuine pre-estimate of the loss which DriveMyCar suffers as a consequence of the cancellation, and which amount the Renter agrees to pay to DriveMyCar immediately on cancellation.
- As an alternative to complying with clause 6.3(b), the Renter may provide the Owner and DriveMyCar with two months’ written notice in accordance with clause 15. No cancellation fee is incurred if the Owner gives notice in accordance with this clause 6.3(c), although a $150 administration fee applies and is payable to DriveMyCar.
If the Owner cancels a Booking after they have signed the Rental Agreement, and the Renter is not in arrears, the Owner agrees that, in addition to the Owner being bound by the cancellation terms in clause 6.3, the Renter may keep the Vehicle until such time as DriveMyCar has found a like for like replacement Vehicle.
